1. Introduction
ARMES respects the intellectual property rights of others and expects users of our Service to do the same. This Digital Millennium Copyright Act ("DMCA") Policy outlines the procedures we follow in response to claims of copyright infringement on our platform, in accordance with the U.S. DMCA and related laws.
If you believe that your copyrighted work has been copied and is accessible via ARMES in a way that constitutes copyright infringement, you may notify our designated Copyright Agent as outlined below.
2. Designated Copyright Agent
If you are a copyright owner or an authorized agent and wish to file a notification of claimed infringement, you may submit such notice to our DMCA Designated Agent:
Email: joseph@armes.ai
Please note that we accept DMCA notices via email only.
3. Content Covered
Users may upload content such as:
- Personal profile pictures
- Agent avatar pictures
- Files sent to bots (including text documents, PDFs, images, GIFs, and animated GIFs)
Note: ARMES does not currently support uploading or sharing of music files, videos, or other media types that may carry heightened copyright risk.
4. Notice and Takedown Procedure
When we receive a properly formatted DMCA takedown notice, we will:
- Review the notice for completeness and validity.
- Promptly remove or disable access to the allegedly infringing content.
- Notify the user who uploaded the content via email about the removal and provide them with a copy of the takedown notice.
- Inform the user that they have the option to download their removed content within a reasonable timeframe before permanent deletion.
- Respond to the complainant and keep a record of all actions taken.
We strive to respond to all valid DMCA notices promptly, typically within 2–5 business days.
5. Counter-Notice Procedure
If you believe content that we removed or disabled was removed in error or misidentification, you may submit a written counter-notice containing the following information:
- Your physical or electronic signature.
- Identification of the content removed and its location before removal.
- A statement under penalty of perjury that you have a good faith belief the material was removed due to mistake or misidentification.
- Your name, address, telephone number, and email address.
- A statement consenting to jurisdiction of the Federal District Court for your district, or if outside the U.S., the jurisdiction where you reside, and that you will accept service of process from the original claimant.
Upon receiving a valid counter-notice, we will:
- Notify the original complainant.
- Restore the content no sooner than 10 business days after receipt of the counter-notice unless the complainant files a court action seeking to restrain you from engaging in infringing activity.
6. Repeat Infringer Policy
ARMES reserves the right to terminate, in appropriate circumstances, the accounts of users who are deemed to be repeat infringers. In line with industry standards, we generally follow a "three strikes" policy:
- Upon the first valid DMCA takedown notice, the user is warned and content removed.
- Upon the second valid notice, the user may be temporarily suspended pending review.
- Upon the third valid notice, the user's account may be terminated.
All actions are at ARMES's sole discretion, subject to applicable laws.
7. User Responsibilities and Warnings
Users are responsible for ensuring that content they upload or share does not infringe on anyone's copyrights or other intellectual property rights.
To reduce risk of copyright infringement claims:
- Do not upload or share music files, videos, or other non-supported media that may be subject to copyright.
- Ensure that profile pictures, agent avatars, and uploaded files are your original work, licensed to you, or used with permission.
8. Content Access After Removal
After removal due to a DMCA complaint, users will receive email notification and will have the option to download their removed content within a reasonable timeframe before permanent deletion.
Users lose access to the removed content until and unless it is restored following a successful counter-notice or other resolution.
9. Communication About DMCA Issues
All communications concerning DMCA takedown notices, counter-notices, and related matters will be conducted via email only, primarily at the address registered with the user's ARMES account.
10. Disclaimer and Limitations
ARMES does not monitor the content uploaded by its users proactively. However, upon notification of alleged infringement, we act expeditiously to address the issue in accordance with the DMCA.
This DMCA Policy applies only to infringement claims submitted by copyright owners or their agents. Other legal claims or disputes are governed by ARMES's Terms of Service and applicable law.
